I was given an order where a social worker would monitor me for a year. After six months the social worker told the court that she didn't now why I was put on this order and had it withdrawn. We should all be subjected to the same system o f justice but we are not. If there is something going on where business owners don't have to face charges or even answer honestly in a court room then there is no such thing as js Scottish justice system. Lynn Herbert's partners still operate her practice in Leven High Street but Miss Herbert herself retired in October 2014.

There were six prosecution witnesses. Lewis's son whom I'd never seen, the tenant of the chip shop flat and her daughter, two of her pals and one of Lewis' employees. No independent witnesses. Where were the customers I was supposed to have soaked – nowhere. There were twelve working CCTV cameras in the area where these alleged offences were supposed to have taken place. The prosecution could not provide one piece of footage to support their case. What did Miss Herbert do about all this – absolutely nothing After I was found guilty of three of the offences ( the witnesses to the fourth told such blatant lies George Way could not have gotten away with finding me guilty), I told Miss Herbert how disappointed I was with her poor defence. On the morning of the trial though Ms Herbert told me the Fiscal Depute had changed her mind and would be pursuing charge two but wouldn't be putting Lewis in the witness box as he had little to offer. I objecting stating he was the witness we really wanted to cross examine. Also, I had given all my medical documents, surgeons reports, x-rays scans etc showing that due to the arthritis in my shoulders, I could not have been hanging out the window throwing water. She did not present them at court and in fact did nothing at all. Despite being a prosecution witness, Lewis was allowed to sit in the public gallery and pass on information to the other witness. In the two years three months this trial took to reach Dundee, many items had gone missing from outside my door but although I knew who the thief was, I could not prove it. It was only when a neighbour put up two CCTV cameras at the top of the wynd, that Lewis was shown on camera to steal plants drying outside my door that I could contact the police. Under the 1968 Theft act it does not matter if the stolen property has any monetary value only that the goods belonged to me. St Andrews sent out one of Lewis's pals and he telephoned to say he would not be charging Lewis despite having the camera footage. . I contacted Police Scotland Edinburgh and they forced St Andrews to send two new officers and charge him. This charge did not reach court as the Procurator Fiscal decided it was disproportionate to the offence I don't know who Lewis's solicitor was for Lee Corr had now left Thorntons and joined Dundee Procurator Fiscal's office. This is when the Wee Chippy launched its campaign of harassment against me. First it was malicious complaints to Kingdom housing which, the association sent me copies. There was even a complaint to the SSPCA claiming I was neglecting my cats. An SSPCA officer came out and found the cats 'living like lords' and told me to contact the police. A lot of good that would have done. Lewis had several pals at St Andrews Police Station When the Kingdom housing campaign of harassment didn't work, Lewis then contacted his friends at Fife Council. He had installed a cordon taking up half the wynd to trap customers. Fife council ignored complaints from wheel chair owners and other disabled wynd users who could not get past it but sent me a written warning to remove a small piece of trellis to I put up to protect my plants from the cigarette ends and rubbish thrown by chip shop customers. Lewis's solicitor Lee Corr sent me a couple of letters claiming I had thrown dog excrement in the chip shop

It was obvious that the residents would be subjected to the noise of customers forced to stand out in the narrow wynd due to the new design, the overpowering smell of chip fat invading their homes and risk of fire. Those chip pans had gone on fire once already. There was no planning application lodged with the Council for us to object to, so we sent a petition to Fife Council. As there was the requisite seven objections we were assured the planning application, when it was received, would go to a planning committee. It did not, the permission was passed quietly on the say so of one planning officer. I was later told that the council had forgotten an old rule that said a a petition would be classed as just one objection. Health and safety had been involved and the two officers who came out, reported that the noise, overpowering smell and risk of fire was unacceptable, The Council said they lost the report. of half a million pounds . Around 11.45 am, one Sunday In November, 2018 the frying pans in the chip shop part on Shore Street went on fire. . The flames raged up through the roof at the front of the building. Unfortunately, it was Remembrance Sunday and at this time the officers from Anstruther Fire Station always attended the service at the war memorial in Cellardyke. By the time St Monans Fire Service could attend the fire had caused irreparable damage to the front of the building. Luckily, the shop was closed and there was only one person on the premises. The family living in the flat above the shop were away out early that day. Lewis and Fleming employed a very efficient architect, for almost immediately work commenced to move the take-away up the wynd to where the cafe part had been. It's the duty of every criminal law solicitor to build the best possible defence for her client. Does a solicitor put in as much effort for a legal aid client as a private one though? Is token representation all a legal aid client can expect or in the case of Lynn Herbert solicitor not even that. I gave her all the evidence to prove my innocence. She held all the cards and didn't play one. The Wee Chippy is situated at the bottom of Tolbooth Wynd Anstruther, an eight food wide path running from the High Street to Shore Road. The Chip shop is a grade 'B' listed building which means no alterations can be made to it inside or out without planning permission. When I moved to Tolbooth Wynd in 2011 my front door was opposite the cafe section but there was no trouble or problem with noise. It was a well run business but all that changed around 2017. Worst person / lawyer I've ever met in my life

Unprofessional rude and clearly incompetent was paid thousands of pounds to basically do a report that was supposed to be impartial ! Miss Herbert did not report the facts instead turned up at my home with her mind already made up reported a pack of lies and inaccuracies worded to suit her own pre formed views without looking at the facts any lawyer with an ounce of decency would have been more diligent and professional when dealing with a family matter made my daughter cry an absolute disgrace to her profession. And to add her views of an assault on a 12 year old child in her own bedroom she describes it as understandable ! While the police child protection team see it as assault and threatening and abusive behaviour towards a child but Miss Herberts view is it's just understandable. She fancy herself as a psychologist however whatever has happened to this woman she needs one to stop causing the damage she is being allowed to do.
